(Peregrine Bertie), but as Lent began on Wednesday 17 Feb., the performance probably occurred on Shrove Tuesday. This performance is on the L. C. list, 5@147, P. 125. John Povey to Sir Robert Southwell, 18 Feb. 1685@6: Sir, the enclosed had been sent last post, had it not been detained late by a play at Court which ended our Carnival. The night before the King and Queen were entertained by the Lord President at a ball or masque in Lady Portsmouth's lodgings. The Masquers were twelve couples whose habits were of several nations' and prescribed by a picture sent to each of them from the Queen, and the least habit cost !bove a hundred Pounds, and some above three hundred pounds, besides jewels of which Mrs Fox and some others had above thirty thousand pounds value each (Savile-Finch Correspondence, Add. Event Comment: The warrant for the export of the goods of the French comedians who acted in the late summer is dated this day. See Calendar of Treasury Books, 1685-1689, p. 2082, and Boswell, Restoration Court Stage, p. 128. During October #200 was paid to John deSureis for himself and eleven companions, the French comedians who had been at Windsor (Boswell, Restoration Court Stage, p. 128)

Event Comment: An order of the Court of Common Council for London forbids any performances of plays or interludes at Bartholomew Fair. [On this Day appeared the Daily Advertiser a full column presentment by the Court of Westminster to the Justices of the Peace against unlicensed players]: This court being inform'd that common Players of Interludes have for several years...assembled...in Mayfair to erect Booths and exhibit Drolls and Shews...whereby numbers of His Majesty's subjects have been encouraged to assemble and commit riots and other Misdemeanours in Breach of His Majesty's Peace, and to the disturbance of the Neighborhood, and that some of the players are and now contracting for ground in order to erect Sheds, Booths and other places...for shewing and acting plays...&c, &c, &c...for the more effectual suppressing of the evils aforesaid, it is hereby recommended unto his Majesty's Justices of the Peace to meet together at such time as they shall appoint in order to proceed according to the law against all such offenders as shall be brought before them by the peace officers, who are required to be aiding the Justice of the Peace. [The gist of the Presentment lies in the statement]: that they [the Justices] shall apprehend all and every other person and Persons who in any other place or places within the said City and Liberty shall act or represent for gain, any Tragedy, Comedy, Opera, Play, Interlude, Farce, or any other Entertainment for the stage

An Old Officer who had been in His Majesty's Service 46 years, but dying when upon half-pay has left the Widow without pension and with several small children in greatest distress. N.B. Event Comment: [Macklin dismissed after this night. See the account in The Genuine Arguments of the Council, with the Opinion of the Court of the King's Bench, &c., By a Citizen of the World, (London, 1774). Extracts in E. R. Page, George Colman, the Elder (New York, 1935). See notes for 23 and 30 Oct. and the subsequent action in note for 20 Nov. He did not return until 18 May 1775. This night was aparently, except for #4 5s. which was not recorded on the books of the theatre until 18 June well after the season closed. Macklin's suit in court against the rioters was judged 24 Feb. 1775. A column and a half account of the trial appeared in the Public Advertiser, Saturday 13 May 1775, giving the testimony of the witnesses accused of starting the riot, the lawyers, and the judge. The accused were Leigh, Miles, James, Aldus, and Clarke. The first four were convicted of a conspiracy and a riot, the last of a riot only. During the Course of the Business Lord Mansfield took Occasion to observe, that the Right of Hissing, and Applauding in a theatre was an unalterable Right, but there was a wide Distinction between expressing the natural Sensations of the Mind as they arose on what was seen and heard, and executing a pre-concerted Desagn, not only to hiss an Actor when he was playing a Part in which he was universally allowed to be excellent, but also to drive him from the theatre, and effect his utter ruin."
