Pepys does not indicate that this performance is the premiere, and Summers, The Playhouse of Pepys, p. 137, states, without offering his evidence, that the play first appeared on 11 Aug. 1664. The play also appears in Herbert, Dramatic Records, p. 138. If Pepys saw the premiere, the play was possibly given on 15, 16, 17, 18, 19, 20, 22, 23, 24 Aug. Event Comment: [Macklin dismissed after this night. See the account in The Genuine Arguments of the Council, with the Opinion of the Court of the King's Bench, &c., By a Citizen of the World, (London, 1774). Extracts in E. R. Page, George Colman, the Elder (New York, 1935). See notes for 23 and 30 Oct. and the subsequent action in note for 20 Nov. He did not return until 18 May 1775. This night was aparently, except for #4 5s. which was not recorded on the books of the theatre until 18 June well after the season closed. Macklin's suit in court against the rioters was judged 24 Feb. 1775. A column and a half account of the trial appeared in the Public Advertiser, Saturday 13 May 1775, giving the testimony of the witnesses accused of starting the riot, the lawyers, and the judge. The accused were Leigh, Miles, James, Aldus, and Clarke. The first four were convicted of a conspiracy and a riot, the last of a riot only. During the Course of the Business Lord Mansfield took Occasion to observe, that the Right of Hissing, and Applauding in a theatre was an unalterable Right, but there was a wide Distinction between expressing the natural Sensations of the Mind as they arose on what was seen and heard, and executing a pre-concerted Desagn, not only to hiss an Actor when he was playing a Part in which he was universally allowed to be excellent, but also to drive him from the theatre, and effect his utter ruin." [A column and a half "Letter to the Author" appeared in the General Advertiser this day, laying historical background for Ford's Lover's Melancholy]. The history of the stage before the Restoration is like a Foreign Land, in which no Englishman had ever travelled; we know there were such things as Playhouses, and one Shakespear a great writer, but the historical traces of them are so imperfect, that the manner in which they existed is less known to us, than that of Eschylus or the theatres of Greece. For this reason, 'tis hoped that the following Gleaning of Theatrical History will readily obtain a place in your paper. 'Tis taken from a Pamphlet written in the reign of Charles I, with this quaint title, "Old Ben's Light Heart made heavy by young John's Melancholly Lover"; and as it contains some historical anecdotes and altercations concerning Ben Johnson, Ford, Shakespear, and the Lover's Melancholy it is imagined that a few extracts from it at this juncture, will not be unentertaining to the Public. [The substance of the remainder retails Jonson's critical cantankerousness and his wounded pride at the failure of the New Inn, quoting some epigrams made at Jonson's expense on his allegation that Ford was a plagiary. This second "puff" for the play, presumably also written by Macklin, formed the basis for a Steevens-Malone controversy late in the century, centering on the existence or nonexistence of the pamphlet referred to by Macklin as "Old Ben's Light Heart made Heavy, &c." Agreement with Sga Paccini, 20 June 1775: "I do agree for my partner, Mr Willoughby Lacy, and myself, to engage Signora Paccini as first dancer at our Theatre, the ensuing season, which commences the first week in September 1775, and finishes the end of May 1776; for which the said Signora shall receive from us, by weekly or monthly payments as she pleases, the sum of three hundred and twenty-five pounds sterling, and she is likewise to have a benefit in course of salary, and at the best time of the year, for which she is to dance whenever she is called upon, to the best of her power and abilities.
